Terms of Service

The current release is a free local preview: no signup, subscription, payment or email flow is available. All learning areas can be explored without an account, with appropriate adult supervision. Work stays in this browser, can be seen by anyone using it and is lost if browser data is cleared. The account and billing terms below concern the separately gated account service; they do not describe a purchase available in this preview.

These terms are the agreement between the grown-up who owns the account and 9626956 Canada Inc., the operator of Maker Caper. They cover the programming challenges, creative studios, saved projects, and related account and subscription services.

Eligibility

You must be at least 18 (or the age of majority where you live) and the parent or legal guardian of any child who plays. By creating an account you confirm you meet these requirements. Maker Caper is set up and managed by an adult; children use only the profiles that account holder creates and supervises.

Accepting these terms

By creating an account you agree to these Terms and to our Privacy Policy. Accepting these Terms creates only the grown-up account; it is not parental consent for child information. We send the account holder a direct privacy notice and verification link, and require a separate parental-consent choice before child profiles or cloud child activity are enabled. If you don’t agree, don’t create an account.

Accounts

A parent or guardian creates and is responsible for the account, the profiles within it, and appropriate supervision of the children who use them. Keep the account credentials secure and tell us promptly if you believe someone else has gained access.

The free tier & subscriptions

Billing & refunds

Payments are processed by Stripe. Prices and the auto-renewal terms are shown before you purchase. Manage or cancel your plan any time from Account settings.

30-day refund: if you’re not happy, contact us within 30 days of a charge for a full refund of that charge. After 30 days, cancelling stops future renewals but past charges aren’t refunded (your access continues to the end of the paid period). This is in addition to any rights you have under applicable consumer-protection law.

Acceptable use

Use Maker Caper for learning and age-appropriate creative work. Do not disrupt the service, bypass access controls, probe another family’s account or data, upload unlawful or harmful material, or use project names or content to harass someone or violate their rights.

Our content & intellectual property

Maker Caper, including its software, curriculum, puzzles, provided artwork, characters, sounds, and starter materials, is owned by 9626956 Canada Inc. or its licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the service for your family’s non-commercial use. Do not copy, resell, or redistribute Maker Caper content outside what the product expressly allows.

Things you create

You keep any rights you already hold in original material created through your account. You give us permission to store, process, copy, and display that material only as reasonably needed to operate Maker Caper, save or reopen the project inside the account, protect the service, or meet a legal obligation. Public project posting, external project links, and sharing between child profiles are disabled at launch. A project file deliberately downloaded to the family’s device is controlled by the account holder. You are responsible for making sure the material is age-appropriate, contains no unnecessary personal information, and does not violate anyone else’s rights.

Privacy and parent controls

The grown-up receives a direct privacy notice, verifies their email, and separately consents before child profiles or cloud child activity are enabled. The account holder can review and download child information, withdraw consent, delete a child profile, or delete the account. A correction is handled as a verified manual request started from the adult account email; do not put child information in that message. Withdrawal stops ordinary child-data use immediately; the data remains frozen for parent review, download, deletion, or renewed consent for up to 30 days before live deletion. Disclaimers

Maker Caper is an educational and creative tool provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Research informs the product’s design, but we do not guarantee specific learning outcomes. Nothing in these terms removes rights you have under applicable consumer-protection law (including Ontario’s Consumer Protection Act) that cannot be waived.

Limitation of liability

To the maximum extent permitted by law, 9626956 Canada Inc. is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some liabilities can’t be limited by law and are not affected by this section.

Governing law & disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to any non-waivable consumer rights, you and 9626956 Canada Inc. submit to the exclusive jurisdiction of the courts of the Province of Ontario.

Changes & termination

We may update these terms or the service. We will update the date above and notify account holders of material changes. We will ask for renewed agreement when required. If a change materially affects how child information is collected, used, or disclosed, we will send a new direct notice and obtain new or separate parental consent where required before applying it to child data. You may delete your account at any time from Account settings.

Severability

If any part of these terms is unenforceable, the rest still applies.
