Eligibility

You must be at least 18 (or the age of majority where you live) and the parent or legal guardian of any child who plays. By creating an account you confirm you meet these requirements. Maker Caper is set up and managed by an adult; children play only under profiles the account holder creates.

Accepting these terms

By creating an account you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t create an account.

Accounts

A parent or guardian creates and is responsible for the account and for supervising the children who play under it. Keep your password secure; you’re responsible for activity under your account.

The free tier & subscriptions

Billing & refunds

Payments are processed by Stripe. Prices and the auto-renewal terms are shown before you purchase. Manage or cancel your plan any time from Account settings.

30-day refund: if you’re not happy, contact us within 30 days of a charge for a full refund of that charge. After 30 days, cancelling stops future renewals but past charges aren’t refunded (your access continues to the end of the paid period). This is in addition to any rights you have under applicable consumer-protection law.

Acceptable use

Use Maker Caper for its intended purpose. Don’t attempt to disrupt the service, reverse access controls, or misuse other families’ data.

Our content & intellectual property

Maker Caper, its puzzles, artwork, characters, and software are owned by 9626956 Canada Inc. and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the service for your family’s own non-commercial use. Don’t copy, resell, or redistribute the content.

Disclaimers

Maker Caper is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee specific learning outcomes. Nothing in these terms removes rights you have under applicable consumer-protection law (including Ontario’s Consumer Protection Act) that cannot be waived.

Limitation of liability

To the maximum extent permitted by law, 9626956 Canada Inc. is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some liabilities can’t be limited by law and are not affected by this section.

Governing law & disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to any non-waivable consumer rights, you and 9626956 Canada Inc. submit to the exclusive jurisdiction of the courts of the Province of Ontario.

Changes & termination

We may update these terms or the service; we’ll note material changes and update the date above. Continued use after a change means you accept the updated terms. You may delete your account at any time from Account settings.

Severability

If any part of these terms is unenforceable, the rest still applies.
